Colorado Mediators & Arbitrators evenly divides the costs of arbitration between the claimant and respondent initially. Upon delivering an award, arbitrators may shift these costs as equitable.

 

CoMA works diligently to contain the costs of arbitration in order to provide access to resolution for most people. In lower dollar claims, especially those that would otherwise be eligible for Small Claims Court, the equal division of filing fees reflects a philosophy of neutrality, beginning with the initial stages of the claim.

What if the contract requires AAA rules?
CoMA's Panel Members have been selected to Arbitrate even if another forum's rules are contractually required. In these cases, the arbitration is conducted under the rules specified in the contract, and fees are assessed according to CoMA's Fee Schedule.
