Fee Agreement Terms and Conditions Colorado Mediators & Arbitrators™ is a registered tradename of USADR Inc. USADR Inc. offers an efficient dispute resolution service with simplified and easy to understand terms.  Our clients appreciate our “pay as you go” approach to billing.  USADR does not require a retainer for services.

• Administrative filing fees are collected at the time of filing and are non-refundable.
• Scheduling fees are collected at the time of scheduling a hearing, teleconference, or mediation session.
• Fees for time in excess of scheduled hearing, teleconference, or mediation session are collected at the conclusion of the scheduled event.
• Fees for award writing are due prior to the delivery of such award.

1. FORM OF PAYMENT:  Unless prior arrangements are made, USADR requires a valid credit or debit card to be kept on file to secure ADR fees.  All fees shall be charged to the credit card on record. If the credit card on record is declined, an alternate payment shall be immediately provided to USADR.
2. APPLICABLE FEE SCHEDULE:  Fees shall be charged according to the fee schedule in place at the time of filing a case with USADR.
3. BILLABLE TIME:  Billable time spent in direct contact with the parties including tele-conferences, hearings, and mediations, and shall be billed in hourly increments, whether used in part or in whole.  Billable time for non-contact client work including document review, award writing, review of motions, etc shall be billed in quarter-hour increments.
4. CANCELLATIONS: Cancellations that occur after charges are processed for scheduled hearing or mediation dates shall be charged a $25 processing fee.
5. LATE CANCELLATION FEE:  Cancellations within 3 business days of a scheduled teleconference, hearing, or mediation forfeit the full scheduling fee + Facility fee + Arbitrator's non-refundable traveling expenses.  
6. FACILITY FEES + ANCILLARY COSTS:  Reimbursements for conference room rental shall be paid fifteen (15) business days prior to the hearing or mediation.  Photocopies, facsimile, etc shall be paid at the conclusion of the case.
7. TRAVEL:  Reimbursement for travel shall be negotiated on a case-by-case basis and paid upon scheduling of the hearing or mediation. 8.   OUTSTANDING BALANCES AND COLLECTIONS:  Outstanding balances payable to USADR are subject to a compounding monthly interest rate of 2%. Furthermore, USADR shall not be required to provide any award, decision or work product produced by a mediator or arbitrator until all charges and fees are paid.  Parties agree to pay any fees or costs incurred by USADR  to collect any outstanding amounts owed by client. Such fees and costs may include, but shall not be limited to, collection agency commissions, fees or charges; attorney fees and costs; and court costs. Each party shall be jointly and severally liable for the fees and costs incurred pursuant to this paragraph.
